Request for an opinion on section 163(1) of the Act

This is in response to your email of May 26, 2005, in which you asked whether subsection 163(1) applies when tax returns are filed simultaneously, and how subsection 163(1) would apply in a situation as described below.

Unless otherwise indicated, all statutory references herein are to provisions of the Income Tax Act (the "Act").

Facts

1. Mr. Y is an individual who is resident in Canada for the purposes of the Act.

2. Mr. Y filed his T1 income tax returns for the 2001, 2002, and 2003 taxation years in the 2004 calendar year. The three tax returns were filed simultaneously by Mr. Y.

3. In his T1 income tax returns for the 2001, 2002 and 2003 taxation years, Mr. Y failed to report income of $18,000, $500 and $1,000, respectively.

4. Subsection 163(2) does not apply in this case.

5. It appears that Mr. Y filed his T1 income tax returns for the 2000 and prior taxation years in accordance with the provisions of the Act. Under this first assumption, Mr. Y's income tax returns for the 1998, 1999 and 2000 taxation years were not subject to any audit adjustments.

6. A second assumption is that Mr. Y failed to report an amount of income during one of the 1998, 1999 or 2000 taxation years and was reassessed for that amount.

Our Comments

Although the wording of subsection 163(1) is not entirely clear, it seems to us that the better position is that this provision does not apply where a taxpayer files T1 income tax returns simultaneously for a number of consecutive taxation years and the taxpayer's income tax returns for the earlier taxation years were filed in accordance with the provisions of the Act, and without failure to report income in those earlier years.

It seems to us that the wording of subsection 163(1) has been drafted to reflect the usual situations where taxpayers file their income tax returns annually.

In a situation as described above, the CRA should not apply subsection 163(1) respecting Mr. Y's unreported income under the first scenario described above.

Under the second assumption, if the failure to report an amount to be included in Mr. Y's income occurred in the 2000 taxation year, then the subsection 163(1) penalty could be applied to the unreported income in the concurrently filed returns for each of the 2001, 2002 and 2003 taxation years. If such an omission had occurred for the 1998 taxation year, only the amount of income omitted for the 2001 taxation year could be subject to a penalty under subsection 163(1).

La présente est en réponse à votre courriel du 26 mai 2005 dans lequel vous nous demandez si le paragraphe 163(1) est applicable lorsque des déclarations de revenu sont produites simultanément, et comment le paragraphe 163(1) serait applicable dans une situation telle que décrite ci-dessous.

À moins d'indication contraire, tous les renvois législatifs dans la présente sont des renvois aux dispositions de la Loi de l'impôt sur le revenu ("Loi").

Faits

1. M. Y est un particulier qui est résident du Canada pour les fins de la Loi.

2. M. Y a produit au cours de l'année civile 2004 ses déclarations de revenu T1 pour les années d'imposition 2001, 2002, et 2003. Les trois déclarations de revenu ont été produites simultanément par M. Y.

3. Dans ses déclarations de revenu T1 pour les années d'impositions 2001, 2002 et 2003,

M. Y a omis de déclarer respectivement des revenus de 18 000 $, 500 $ et 1 000 $.

4. Le paragraphe 163(2) ne s'applique pas en l'espèce.

5. Il semble que M. Y a produit ses déclarations de revenu T1 pour les années d'imposition 2000 et antérieures, conformément aux dispositions de la Loi. Selon cette première hypothèse, les déclarations de revenu de M. Y pour les années d'imposition 1998, 1999 et 2000 n'ont fait l'objet d'aucun redressement suite à leur vérification.

6. Selon une deuxième hypothèse, M. Y aurait omis de déclarer un montant de revenu au cours de l'une des années d'imposition 1998, 1999 ou 2000, et aurait fait l'objet d'une nouvelle cotisation à cet égard.

Nos commentaires

Quoique le libellé du paragraphe 163(1) ne soit pas parfaitement clair, il nous semble que la meilleure position est que cette disposition n'est pas applicable lorsqu'un contribuable produit des déclarations de revenu T1 simultanément pour plusieurs années d'imposition consécutives données et que ses déclarations de revenus pour les années d'imposition antérieures avaient été produites conformément aux dispositions de la Loi, et sans omission de déclarer un revenu au cours de ces années antérieures.

Il nous semble que le libellé du paragraphe 163(1) a été rédigé en fonction des situations habituelles lorsque les contribuables produisent leurs déclarations de revenu annuellement.

Dans une situation telle décrite ci-dessus, l'ARC ne devrait pas appliquer le paragraphe 163(1) à l'égard des revenus non déclarés par M. Y, selon la première hypothèse décrite ci-dessus.

Selon la deuxième hypothèse retenue, si l'omission de déclarer un montant à inclure dans le calcul du revenu de M. Y est survenue dans l'année d'imposition 2000, alors la pénalité prévue au paragraphe 163(1) pourrait être appliquée aux revenus non déclarés dans les déclarations produites simultanément, c'est-à-dire pour chacune des années d'imposition 2001, 2002 et 2003. Si une telle omission était survenue pour l'année d'imposition 1998, seul le montant de revenu omis pour l'année d'imposition 2001 pourrait faire l'objet d'une pénalité en vertu du paragraphe 163(1).

Mr. Y filed his T1 income tax returns for the 2001, 2002, and 2003 taxation years at the same time in the 2004 calendar year. In his 2001, 2002 and 2003 taxation years, he failed to report income of $18,000, $500 and $1,000, respectively. On the first assumption, his returns for the 1998, 1999 and 2000 taxation years were not subject to any audit adjustments; whereas, on the second assumption, he failed to report an amount of income during one of the 1998, 1999 or 2000 taxation years and was reassessed for that amount.

Regarding the first assumption, CRA stated:

[T]he better position is that [s. 163(1)] does not apply where a taxpayer files T1 income tax returns simultaneously for a number of consecutive taxation years and the taxpayer's income tax returns for the earlier taxation years were filed in accordance with the provisions of the Act … .

… [T]he CRA should not apply subsection 163(1) respecting Mr. Y's unreported income under the first scenario … .

Regarding the second assumption, CRA stated:

[I]f the failure to report an amount to be included in Mr. Y's income occurred in the 2000 taxation year, then the subsection 163(1) penalty could be applied to the unreported income in the concurrently filed returns for each of the 2001, 2002 and 2003 taxation years. If such an omission had occurred for the 1998 taxation year, only the amount of income omitted for the 2001 taxation year could be subject to a penalty under subsection 163(1).
